The Court of Appeal has set aside contempt proceedings brought before it by the former Governor of Kogi State, Yahaya Bello, against the Chairman of the Economic and Financial Crimes Commission, Olanipekun Olukoyede.
Justice Joseph Oyewole, who read the unanimous judgment, set aside the proceedings while overruling the Respondent’s preliminary objection, citing technicalities.
Meanwhile, the court awarded N1million cost against the respondent.
The Court had earlier granted an ex-parte motion for stay of contempt proceedings filed against Olukoyede, by ex-governor Bello.
It would be recalled that EFCC operatives had laid siege on the residence of the former Kogi governor, on April 17, in a bid to arrest him despite a court order restraining them from taking such action, pending the determination of the originating motion.
