The impeachment investigation panel against Edo State Deputy Governor, RT. Hon Philip Shaibu, chaired by retired Justice S.A. Omonuwa, announced on Wednesday that it would continue its probe, citing the absence of a court order prohibiting its proceedings.

This ruling came after counsel to Shaibu, Professor Oladoyin Awoyale (SAN), raised objections to the continuation of the investigation, citing an order from an Abuja Federal High Court. The court had adjourned a case filed by Shaibu to April 8, 2024, for parties to present arguments regarding an interlocutory injunction against the impeachment initiated by the Edo State House of Assembly.

However, Justice Omonuwa (Rtd) clarified that the Federal High Court in Abuja merely requested parties to appear and present their case.

Ohiafi Joe, Deputy Clerk, Legal, Edo State House of Assembly, representing the House’s counsel, argued that according to the Constitution of Nigeria, Section 188 (10), no court has the authority to impede the House of Assembly or the panel from carrying out their constitutional duties.

In response, the panel chairman asserted that the investigation would proceed and urged the House of Assembly to present its case.

Awoyale informed the panel that his client would not participate further in the investigation, seeking permission to withdraw. However, he clarified that this decision did not imply a waiver of their right to defend their client, emphasizing the need to abide by the court’s directive to appear and present arguments.
